These terms govern use of foiphoto.in and enquiries for FOI Studios’ photography, film, music, model-collaboration and promotional services. A signed proposal, estimate, invoice or campaign agreement may add to or replace these general terms for a specific project.
1. Enquiries and proposals
Website information and package prices are starting points, not binding offers. Final scope, dates, deliverables, usage, models, locations, third-party costs, taxes and payment stages are confirmed in writing. A booking is confirmed only after written acceptance and receipt of the stated booking payment.
2. Client responsibilities
The client must provide accurate product information, brand guidelines, deadlines, authorised representatives and all trademarks or materials needed for production. The client is responsible for product delivery, return logistics, fit information and legal rights to supplied assets.
3. Production, changes and delays
FOI may adjust schedules for safety, illness, weather, location restrictions, talent availability or other circumstances beyond reasonable control. Scope changes, reshoots not caused by FOI, rush requests and additional deliverables may require revised fees and dates.
4. Models and conduct
FOI works with professional adult talent. All participants must maintain a safe, respectful and lawful workplace. Campaign usage involving a model is limited to the media, territory, duration and purpose agreed for that project.
5. Intellectual property and usage
Unless transferred in a signed agreement, FOI retains copyright in created photography, film, music, production designs and working files. The client receives the licence stated in its agreement after all due amounts are paid. Raw files, unused takes, project files and editable masters are not included unless specifically listed. FOI may display completed work in its portfolio and awards materials unless confidentiality is agreed in writing.
6. Music licensing
Custom music usage is governed by the project agreement, including media, territory, term, exclusivity and whether publishing or master rights are licensed or assigned. Third-party platform availability and Dolby Atmos labelling are controlled by the applicable music service.
7. Promotion and outcomes
Social promotion, model collaborations, website features and magazine consideration are supplied only when included in writing. FOI does not guarantee reach, engagement, press placement, platform approval, search ranking or sales.
8. Liability
To the extent permitted by law, FOI is not liable for indirect, incidental or consequential loss. FOI’s aggregate liability for a project will not exceed the fees actually paid to FOI for the affected service, except where a limitation is prohibited by law.
9. Governing law and contact
These terms are governed by the laws of India, with courts in Kolkata, West Bengal having jurisdiction, subject to any mandatory consumer law. Questions may be sent to foi.fashionindia@gmail.com.
